In the view of the Court, despite these differences in wording, the three Schedule provisions are clearly
intended to cover all killing, taking and treating of whales that is neither “for purposes of scientific research”
under Article VIII, paragraph 1, of the Convention, nor aboriginal subsistence whaling under paragraph13
of the Schedule, which is not germane to this case. The reference to “commercial” whaling in paragraphs
7(b) and 10(e) of the Schedule can be explained by the fact that in nearly all cases this would be the most
appropriate characterization of the whaling activity concerned. The language of the two provisions cannot
be taken as implying that there exist categories of whaling which do not come within the provisions of either
Article VIII, paragraph1, of the Convention or paragraph 13 of the Schedule but which nevertheless fall
outside the scope of the prohibitions in paragraphs 7(b) and 10(e) of the Schedule.
裁判所の見解では、文言の違いにも関わらず、3つの付表の条項は明らかに、本裁判と直接関係の無い8条1項の
元での「科学調査目的」でも、付表13項の原住民生存捕鯨でもない、全ての鯨を殺し、捕獲し、処理することをカバー
することを意図している。付表の7(b)と10(e)項の「商業」捕鯨への言及はほとんど全ての場合で、関連する捕鯨活動の
最も適切な性格付けだという事実によって説明出来る。二つの条項の文言は条約の8条1項の範疇にも、付表13項の
範疇にも入らないが、それでも付表の7(b)項、10(e)項の禁止の範囲外になる捕鯨のカテゴリーが存在するとほのめ
かしていると受け取ることは出来ない
ここでそれぞれ、7(b)項は
the prohibition on commercial whaling in the Southern Ocean Sanctuary
南極海サンクチュアリーにおける商業捕鯨の禁止
また10(e)は
the obligation to respect zero catch limits for the killing for
commercial purposes of whales from all stocks
全ての鯨資源から商業目的で殺し、捕獲し、処理する、ゼロ捕獲枠を尊重する義務を示す。
すなわち二つの条項が禁止しているのは「商業捕鯨」であり、8条1項の捕鯨、及び付表13項の捕鯨（先住民生存捕鯨）、
及び二つの条項が禁止する「商業捕鯨」、その3つ以外に捕鯨は存在しないというのが裁判所の見解。
故に裁判所が、日本が調査捕鯨と称する捕鯨は8条1項の捕鯨に当たらないと判断した以上、
実質商業捕鯨と判断されたということになる。
